An employee can ask to retire as soon as he fulfills the legal conditions to do so, i.e. once he has reached the minimum retirement age. The latter differs according to his year of birth.

Employees born before July 1951 can retire at any time when they turn 60. The departure date must be set on the first day of the month chosen to retire.

Employees born between July and December 1951 can retire under the same conditions when they reach the age of 60 years and 4 months.

Employees born in 1952 must have reached the age of 60 years and 9 months to claim their pension rights.

Employees born in 1953 can retire from 61 years and 2 months.

Employees born in 1954 can ask to retire as soon as they reach the age of 61 years and 7 months. The departure date must correspond to the first day of the month following the date of the legal retirement age or, for employees born on the first day of the month, to the very day on which the employee reaches this legal retirement age. retirement. Those who have had a long career, who are disabled or who have had a difficult career can claim their pension rights before this age limit.

For employees born in 1955 and later, the legal retirement age is 62, under the same conditions as employees born in 1954.

Who should you send your retirement request to when you work in the private sector?

To his general scheme pension fund

The employee who wishes to claim his pension rights must, as soon as he has defined the date on which he wants to stop his professional activity, make a request to his pension fund under the general social security scheme, the agricultural scheme (MSA), the social regime for independents (RSI) or the cult regime (Cavimac). This request can be sent using the Cerfa form n°10916*08 "Single request for personal basic pension", accompanied by the mandatory supporting documents (photocopy of proof of civil status, bank account statement, photocopy of the last income tax notice or notice of income tax declarative situation) and other optional supporting documents related to the situation of each applicant. The form can be sent by post or given directly to the pension funds of the general scheme. The request for retirement can also be made very easily online on the Pension Insurance website, in the personal space of each employee.

For employees who have contributed to various general pension schemes during their career, and who were born in 1953 and after, the request for retirement is made using the "single pension settlement" system with the last scheme. where they contributed.

To his supplementary pension fund

Employees must also apply for payment of their supplementary retirement pension. They must complete this process six months before the desired retirement date. The request is possible online on the Agirc and Arrco website, section "My online pension request", as well as by post.

To his employer

No law defines an official procedure to inform his employer of his wish to assert his pension rights. In some cases, however, the conditions for this approach are provided for in collective agreements or the employment contract. With regard to the deadline, the employer must be notified fairly early, under the same deadline conditions applicable to the notice of dismissal (a notice period of two months if the employee has at least two years of seniority, for example). Permanent civil servants must submit their request for retirement at least six months before the desired date of cessation of their activity. Depending on their public service, the conditions are different.

State officials
